Counter-Notification by Alleged Infringer

If you believe that your material was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification (“Counter-Notice”) to our Designated Copyright Agent. Your Counter-Notice must include the following:

Identification of the materialthat was removed or disabled and the location where it appeared before removal. A statement under penalty of perjurythat you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification. Your contact information, including your full name, mailing address, telephone number, and email address. A statementthat you consent to the jurisdiction of the federal district court in your judicial district (or the district where your address is located) and that you will accept service of process from the party that filed the original DMCA Notice or their agent. Upon receiving a valid Counter-Notice, we may restore the removed material unless the copyright owner initiates a court action against the alleged infringer within 10 business days of receiving the Counter-Notice.

Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, we maintain a policy for terminating, in appropriate circumstances, users who are repeat infringers. A repeat infringer is any user who has been the subject of multiple DMCA Notices for different instances of copyright infringement. We reserve the right to suspend or terminate any user’s access to our Services at our sole discretion.

Misrepresentation

Under the DMCA, any person who knowingly materially misrepresents that material or activity is infringing or was removed or disabled by mistake may be liable for damages, including costs and attorneys’ fees. We may seek damages in appropriate cases where a false DMCA Notice or Counter-Notice causes harm.
